Gratuity under the UAE Labour Law applies to non-UAE nationals working for private-sector employers on the mainland and in most free zones.
From the first day of work to the last working day, as on the labour contract and cancellation.
Gratuity is worked out on the last basic salary only — not on housing, transport or other allowances.
An employee with a basic salary of AED 6,000 a month who worked 7 years and 6 months.
Basic salary ÷ 30
6,000 ÷ 30 = AED 200 a day
5 years × 21 days = 105 days
2.5 years × 30 days = 75 days
Total 180 days
180 days × AED 200
= AED 36,000
Below the cap of 24 × 6,000 = AED 144,000
Payroll, leave, WPS salary files and end-of-service gratuity in one system built for the UAE and GCC. Gratuity is accrued every month, so the settlement is ready the day someone leaves.
Under Federal Decree-Law No. 33 of 2021, gratuity is 21 days of basic salary for each of the first five years of service and 30 days for each year after that. A day's wage is the monthly basic salary divided by 30. Part of a year is paid in proportion to the time worked, and the total can't exceed two years' salary.
Non-UAE nationals working for a private-sector employer who have completed at least one year of continuous service. Part-time workers are entitled in proportion to their hours. Unpaid leave days are not counted as service.
No. Under the current Labour Law, resigning doesn't reduce gratuity, as long as you completed at least one year of continuous service. The older rules that cut gratuity for resignations no longer apply.
On the last basic salary only. Housing, transport and other allowances, commission and benefits in kind are not included — which is why the basic salary on the contract matters.
All end-of-service dues, including gratuity and pay for unused leave, must be paid within 14 days of the end of the contract. The employer may deduct amounts the employee owes, such as an outstanding loan.
Private-sector employers can choose to join an approved savings scheme instead of paying gratuity at the end of service. If your employer has joined one, monthly contributions replace the calculation on this page. DIFC and ADGM run their own savings schemes.
